There are some prescribed health conditions that are automatically covered by the new Equality Act or the old Disability Discrimination Act (DDA) but in most cases only a tribunal can decide whether the Act actually applies to an employee. However an Occupational Health professional and, in particular, an Occupational Health Physician's opinion will be taken into due consideration in such an environment.

We only use Occupational Physician is for our assessments following a management referral. If so required, as part of a normal OH referral, the OH Physician will express an opinion on whether the Equality Act (or previously the DDA) would apply.
